Terms of service

These terms are an agreement between Tendroom (“we”, “us”) and the business using Tendroom (“you”). By using Tendroom you agree to them. If you use Tendroom on behalf of a business, you confirm you can agree for that business. Our privacy policy explains how we handle personal information.
The service
Tendroom gives your business a private portal to manage clients, invoices, galleries, schedules and your team, plus a contact page and secure links you can share with your clients. We're in early access: we set businesses up by hand, and we may add, change or remove features as the service grows. We'll tell you ahead of time about changes that take away something you rely on.
Your account and team
- Keep your sign-in details private and tell us right away if you think someone else has used your account.
- You choose who joins your team and what role they have. You're responsible for what your team does in your portal.
- Give us accurate contact details so we can reach you about your account.
Your data
You own the information you and your team put into Tendroom. You give us permission to store, process and display it only as needed to run the service for you, including sending the emails and links you ask us to send.
You're responsible for:
- Having the right to upload what you upload, including photos and information about your clients and staff.
- Telling your clients and staff how you use their information, and getting any consent the law requires.
- Following the law in the emails you send through Tendroom, including anti-spam rules.
You can download your clients, invoices and hours from your portal at any time.
Acceptable use
Don't use Tendroom to:
- Break the law or help someone else break it.
- Send spam or messages people didn't ask for.
- Upload content you don't have the rights to, or content that's harmful, harassing or sexually exploits anyone.
- Upload malware, or try to get into accounts, data or systems that aren't yours.
- Overload, disrupt or reverse-engineer the service, or resell it without our written permission.
If you break these rules, we may remove content or suspend your account. When we can, we'll tell you first and give you a chance to fix it.
Fees
- We agree the price with you before we bill you for anything. Payment is arranged directly with us for now.
- Fees are for the period they cover and aren't refunded for part of a month, unless we agree otherwise.
- We'll give you at least 30 days' notice before changing your price.
- If a payment is late, we'll contact you. If it stays unpaid, we may suspend your account until it's settled.
- You're responsible for any taxes on your fees, other than taxes on our income.
Ending the service
You can stop using Tendroom at any time: download everything from Settings, then close your business there (or tell us). A closed business goes offline straight away and is erased 30 days later; until then we can reopen it if you ask. We may end or suspend your account if you seriously or repeatedly break these terms, don't pay, or if we stop offering the service, and we'll give you reasonable notice when we can. After your account ends, you'll have 30 days to ask us for a copy of your data. After that we may delete it.
Other services
Tendroom relies on other companies, such as our hosting, storage and email providers, and works alongside tools you choose, such as your own website. We're not responsible for services we don't control.
No warranty
We work hard to keep Tendroom running and your data safe, but the service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted or error-free, or fit for any particular purpose. Keep your own copies of anything you can't afford to lose.
Limit of liability
To the extent the law allows, neither of us is liable to the other for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about Tendroom is limited to the fees you paid us in the 12 months before the claim. These limits don't apply where the law doesn't allow them.
Claims about your content
If someone makes a claim against us because of content you uploaded or how you used Tendroom in breach of these terms, you'll cover the reasonable costs of that claim.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California, and both of us agree to those courts.
Changes to these terms
We may update these terms. We'll change the date at the top and, for important changes, email you at least 30 days before they take effect. If you keep using Tendroom after that, the new terms apply.
